The NSW Housing Code has been changed significantly to expand the range of Exempt and Complying Developments increasing the number of properties to which the Code will apply.

According to an article by Clare Larkin, HIA Planning & Building Services Manager in the March 2011 edition of the NSW HIA Building News, the most significant change is the reduction of the minimum lot area from 450m2 to 200m2 which will allow dwelling houses, alterations and additions and other types of low impact development to be carried out as complying development on smaller lots.

The amendments to the Code were introduced on 25 February 2011.

So if you are currently designing your new home or your home extension, it would be in your interests to seek advice from your architect/draughtsperson on whether your home improvement plans would qualify under the revised rules. If your development qualifies under the new rules, it would mean a significant streamlining of the Council approval process reducing the time required from 6/8 weeks to 2/3 weeks.
